II The humanitarian program of penal reform consisting in the introduction of the ideas on the Enlightement in 18 th century as the most significant turning point in the modern history of criminal law.The requests of Italian and French philosophers for a mitigation of overall penal repression, for introduction of the principles of legality (nullum crimen sine lege) and for protection of human liberties in the criminal proceding (habeas corpus)
