Jurisprudence of the European Court of Human Rights on protection of freedom of speech and religion 4003-SEM-LIC-WS
The subject- matter of the seminar concerns a range of problems arising out of the rich case law of the European Court of Human Rights (ECtHR) regarding freedom of expression (Article 8 of the European Convention on Human Rights) and freedom of conscience and religion (Article 9), including the inter-relations of those two categories of freedoms, both protected by the European Convention. It will be a bi-lingual seminar (in Polish and English).
Some of the topics which may be covered by the seminar are the doctrinal positions of the European Court of Human Rights regarding:
1. Hate speech and the limits of its legal protection
2. Limits of penalizing the violations of religious sensibilities
3. Limits of legal protection of homophobic expressions
4. Incitement to ethnic and racial hatred
5. Protection of symbols related to totalitarian ideologies
6. Offence and defamation of public officials
7. Hate speech in the Internet
8. Limits of freedom of press
9. Protection of confidential journalistic sources
10. Protection of religious symbols (in particular, crucifixes in public schools and other public spaces)
11. Teaching religion in public schools
12. Limits of legal regulations of religious garb (in particular, required by Muslim faith)
13. Public education an d religious convictions of parents
14. Protection of religious identity and the duty to reveal one’s religious convictions
15. Recognition, organization and authorities of churches and other religious institutions: limits of state regulation
16. Legal protection of religious proselytizing
17. Limits of state authority to establish religious holidays and days free of work
18. Limits of protection of religiously motivated conscientious objection

Dates of the seminar: Mondays 10:00-12:00. Each seminar will be conducted by Skype and will have the form of individual discussions between a student and Professor Sadurski. A student should first make an appointment by Email.
At least once in a semester Professor Sadurski will attempt to organize a session in Warsaw for all students enrolled in the seminar.

Assessment criteria
Assessment of the seminar :
Semester I:
- attendance,
- the formulation of theses research
- identification of the research problem (theme of the work), preparation of plan of work divided into chapters,
- collecting literature and building a proper bibliography,
- critical analysis of the material
- raising the competence of language, grammar and spelling, developing the skills of drafting and editing.
Semester II :
Presentation at the seminar meetings consecutive chapters work in the order of their writing and regularly consulting their content.
Supervisor assesses: systematic work, the clarity of the plan and narrative, completeness theses, language and style, correct scientific workshop (bibliography, footnotes), original nature of the work, diligence editing.
The pass mark for the whole of the seminar is to allow the seminarian to defend on the basis of approved work.
