Legal Aspects of The Spatial Planning 4208-M2PPGP
The course discusses legal aspects of land use planning. The course encompasses getting the students acquainted with the problems of functioning of public administration, its competences in the sphere of land use planning, rules governing preparation of land use planning regulations on different levels of local government and the state, as well as introduction to legislative technique.
Completion of the course requires substantial individual work by the students. On average, active participation in the course requires around 4 hours of individual work per each hour of lectures.
The structure of the course was designed as a complex introduction to legal regulation of the spatial development system, with special emphasis on land use planning:
• spatial development as a public task – forms and methods of realization;
• sources of law in the field of spatial development and land use planning;
• organization of public administration in the field of spatial development and land use planning, division of power between the local government and government administration;
• spatial development – main concepts, legal and economic terms in spatial development;
• forms of action of public authrities, legal character of acts in spatial planning and spatial planning procedure;
• land use development – procedures and organization;
• legal techniques and their use in the spatial development process;
• the scope of the spatial development planning;
• documents in spatial planning and other documents connected with the legal aspects of land use planning;
• decision making rules in spatial development and land use planning (the rules and organization of administrative procedure;
• decision control in spatial development – appeal proceedings;
• European integration and its influence on national solutions.

Completion of the course requires positive verification of acquires knowledge (more than 60 % of correct ans wers on a multiple choice test).
