Negotiation 2200-FOR40
The course is designed as a comprehensive ADR workshop. While it is starts with negotiation, its subsequent parts extend to mediation, arbitration and other “alternative” methods of resolving disputes.
The theoretical part of the course presents some elements of the theory of conflict and dispute resolution processes, as well as the legal environment of ADR. The focus is on some recent developments, such as e.g. the EU Directive 2008/52/EC of 21 May 2008 on certain aspects of mediation in civil and commercial matters, the 2006 Revised UNCITRAL Model Law on International Commercial Arbitration, and current legislative trends in leading jurisdictions.
The practical part of the course includes a number of simulations, role-play and workshops based on international business practice. They aim to illustrate both some theoretical problems and real life situations.
Materials used: Collection of articles, book chapters, court decisions, case scenarios, etc. The course requires completion of a reading assignment prior to the class meeting. A course syllabus and advance reading assignment will be e-mailed to all participants.

Efekty kształcenia
The overall purpose of the course is to familiarize students with the alternative dispute resolution law and practice, including most current developments and trends, from international perspective.
Kryteria oceniania
The students are required to write their blogs during the entire semester, in which they share their thoughs and observations based on the assigned readings, discussions and simulations in the class. The blogs are available to all the participants.
