Specialisation Seminar - Contractual obligations with particular regard to consumer law 2200-1F092
The seminar deals with a wide range of issues in the field of contractual obligations, with a focus on consumer issues.
On the basis of selected judgments and literature, the practical and theoretically inspiring questions of the general and particular parts of the obligations are analysed.
Most of them relate to consumer contracts, such as consumer sales and credit, timeshare, package travel contracts.
Problems relating to consumer rights (e.g. right of information, right of withdrawal), unfair contractual terms and the nature of the relationship (e.g. in the case of foreign currency credits) and the impact of an extraordinary change of circumstance on the obligation (e g. in the case of package travel contracts), implementation of new consumer directives are raised.
Some seminars may relate to other contracts, e.g. construction work, distribution, franchise.

Learning outcomes
The student should be able to identify legal problems, identify possible solutions and formulate arguments based on law, case law and legal literature.
Assessment criteria
Assessment is based on attendance (permissible 2 absences per semester), student activity and written work (e.g. commentary of a judgement) or presentation during the seminar.
Bibliography
Literature and case law on a particular topic are communicated to the students at least a few days in advance.
