European identity. Values from Art. 2 TEU, their essence and legal nature. The rule of law. Atomic procedure under Art. 7 TEU. A new EU framework to strengthen the rule of law. Rule of law mechanism. Mechanism of financing conditionality on the rule of law. Exclusion from the EU. Poland and the EU and the rule of law. SOURCES OF EU LAW: Catalog and hierarchy of sources of EU law. EU TREATY: The concept of primary law. Legal nature, structure, validity and application of Treaties. THE CHARTER OF FUNDAMENTAL RIGHTS OF THE EU AND GENERAL PRINCIPLES OF LAW: Legal nature, structure, validity and application of the Charter of Fundamental Rights. General principles of law. INTERNATIONAL AGREEMENTS: Legal nature, structure, validity and application of international agreements concluded with third countries and international organizations. REGULATIONS: Legal nature, scope, addressees, structure, content, validity, application and effects of regulations. DIRECTIVES: Legal nature, scope, addressees, structure, content, validity, application and effects of directives. DECISIONS: Legal nature, scope, addressees, structure, validity, application and effects of the decision. OTHER EU ACTS: Legal nature, scope, addressees, structure, validity, application and effects of recommendations and opinions as well as soft-law acts. CJEU case law. PRINCIPLES OF EU LAW: The legal nature of the principles of EU law and their typology. PRINCIPLE OF CONFERRED COMPETENCES: Exclusive EU competences, shared, ancillary (complementary), implied, exclusive competences of the Member States. The principle of respect for the national identity of member states. PRINCIPLES OF LAW-MAKING: The essence, meaning and effects of the principles of subsidiarity and proportionality. Knowledge:
The graduate knows and understands the administrative structure of the EU and European countries as well as the normative and functional-structural conditions of competences of the EU authorities, state and local government authorities of the Member States and their mutual relations K_W05;
The graduate knows and understands the features of legal and social norms constituting and regulating European social structures and institutions, including the law on the protection of intellectual property and the sources of these norms, their specificity, evolution and impact on human behavior K_W10;
Skills:
The graduate is able to observe, interpret, analyze and describe social processes and phenomena, including the relationships between phenomena and processes in the political, administrative and socio-economic spheres in Europe and within European countries K_U01;
The graduate is able to use the conceptual framework and nomenclature of institutions and procedures in the European Union K_U02;
The graduate is able to analyze the conditions and mechanisms of functioning of selected EU institutions and institutions of the Member States K_U03;
The graduate is able to use universal normative systems and selected norms and rules appropriate for selected institutions and structures in order to properly manage and manage the institution and its affairs, as well as to solve tasks within the scope of their competences K_U05;
The graduate is able to develop and present the results of scientific research and use them to analyze and solve scientific problems and implement solutions to practical social problems relevant to European studies and the workplace in public administration K_U08;
The graduate is able to prepare written works individually and collectively in Polish and English on political, social, cultural and economic issues in Europe and the European Union, using basic concepts and theoretical approaches as well as various sources of information relevant to European studies K_U09;
