Administrative decisions in environmental protection 4030-DAwOŚ
As part of the course, students learn the legal regulations of the Code of Administrative Procedure necessary to issue decisions in environmental protection. They gain knowledge about the individual phases of administrative proceedings, including the initiation of proceedings, taking evidence, and preparing an administrative decision. They learn the concept of parties and participants in proceedings, the catalog of means of evidence and the formal requirements of administrative decisions. The exercises are also intended to familiarize students with the deadlines for settling a case in administrative proceedings and the measures to counteract inaction and lengthy proceedings arising from the Code. For this purpose, students become familiar with current court decisions regarding administrative proceedings, including the concept of legal interest, the possibility of allowing a social organization to participate in the proceedings, and the rules governing evidentiary proceedings. Students practice the functioning of the legal institutions they learn on examples of decisions issued on the basis of selected substantive law acts, e.g. the Nature Protection Act, the Forest Act, the Act on the Protection of Agricultural and Forest Land, and the Hunting Law Act.

After completing the classes, the student:
- knows the concept and formal requirements of an administrative decision,
- knows the concept of administrative proceedings and is able to indicate its course,
- can indicate examples of administrative decisions issued in environmental protection matters,
- understands the basic obligations of an administrative body in administrative proceedings,
- understands the concept of a party and a participant in administrative proceedings,
- knows the catalog of general principles of administrative proceedings.
Assessment criteria
Passing the classes on the basis of a written colloquium covering the basic issues of administrative proceedings: general principles of administrative proceedings, deadlines for settling cases, parties to the proceedings, evidence, decisions. For a rating of 5 or 5! an additionally required project involving the preparation of an administrative decision based on the developed case.
