The classes concern the most important aspects of people management in the formal and legal perspective. Gaining knowledge in this area is essential for people who manage or will manage staff in the future. This is to prevent legal risks related to the violation of regulations on the employment of people in organizations. The classes refer to the employment processes – from the choice of the form of employment, recruitment methods, conditions to be provided to employees, undesirable phenomena in employment relations, and ending with the termination of the contract. The classes include elements of the functioning of the organization in the context of employment in the social environment, including the context of social dialogue.
During the lecture, general content will be conveyed in the field of the subject matter, during the exercises the skills in the subject matter will be improved.
1. Characteristics of the flexible company model in the Polish legal reality (employment: employee and non-employee, self-employment, civil law contracts, internships and graduate apprenticeships)
2. Preparation of a personnel strategy and defining the criteria for hiring and selecting employees as well as relevant documents (employment contracts, civil law contracts, graduate internship agreements, managerial contracts, non-competition agreements).
3. Contracts - elements/differences/costs of employment contracts, contracts of mandate, contracts for specific work, B2B
4. Monitoring and the protection of personal data and the employee's right to privacy (the limits of monitoring, the most common forms of monitoring and their admissibility under Polish law).
5. Legal aspects of recruitment, rights and obligations of the parties to the employment relationship, shaping working conditions and pay, promotion.
6. Sources of company law (work, remuneration and bonus regulations) codes of ethics
7. Motivation and remuneration taking into account employee appraisals, minimum wage
8. Working time management (selection of the working time system, preparation of working time schedules) and holidays (creation of annual leave plans)
9. Counteracting undesirable phenomena in employment
10. Redundancies (including collective redundancies) initiated by the employer and the employee
11. Cooperation with trade unions and other employee representatives
12. Preparation of procedures and documents terminating employment contracts and civil law contracts

K_W01 Knows and understands in depth the terminology in the field of labour law
K_W02 knows and understands at an advanced level the principles, procedures and practices concerning the activities of various types of organizations, its key functions (personnel management – labor law) and its relations with the environment.
K_W05 knows and understands social and political processes and their impact on the functioning of the organization and the economy as a whole, especially in the field of employment.
K_W06 knows and understands the principles of creating and developing various forms of entrepreneurship, especially in terms of selecting various forms of employment and the resulting obligations to the type of business

K_U01 Can use labor law theory to identify, diagnose and solve problems related to the hiring process
K_U02 Can correctly interpret social, political, legal, economic and ecological processes and phenomena and their impact on the functioning of the organization, using the appropriate selection of sources
K_U03 Can independently and in a team prepare analyses, diagnoses and reports on the functioning of the organization in the field of personnel management
K_U05 Can plan and organize their own and teamwork.
K_U06 They have the ability to self-educate and improve their qualifications.

K_K01 is ready to assess and critically approach the situation and phenomena related to the functioning of the organization and the entire economy in terms of employment
K_K02 Is ready to think and act in an entrepreneurial way, especially in the field of personnel management
K_K03 Is ready to comply with and develop professional ethical standards related to personnel management
Assessment criteria
Test – open/closed questions, activity in class, current assessment
The final grade will be calculated according to the following rules: test 50%, current grade 40%, activity in class 10%
Bibliography
Due to the dynamic changes in labour law, the literature should not be older than 2023. Slightly older literature may be used for some issues, although with the reservation that the issues under consideration are up-to-date
