Detailed programme:
1. The origins of international protection of human rights:
a. The philosophical and legal aspects of the concept of human rights and freedoms - the natural law and positive law,
b. The development of the sources of domestic and international law in the field of international protection of human rights.
2. Sources of international human rights law:
a. The international agreements:
i. universal,
ii. regional,
iii. bilateral.
b. the resolution of international organisations and conferences - the legal nature and significance of the so-called "soft" international law,
c. The question of international custom as a possible source of international obligations to protect human rights.
3.The three generations of human rights:
a. political and civil rights,
b. economic, social and cultural rights,
c. general human solidarity rights.
4. Universalism and regionalism in the field of international human rights - complementarity or competition?
5. Institutionalism as a characteristic of the international protection of human rights:
a. consultative bodies with powers to give opinions,
b. judicial and quasi-judicial authorities.
6. The Universal Declaration of Human Rights and the International Covenants on Human Rights – a comparative analysis.
Course coordinators
Learning outcomes
The student knows and understands the sources of international human rights law.
The student is familiar with the human rights protection systems operating within the United Nations.
The student is able to outline the course of proceedings before human rights protection bodies within the United Nations.
The student has ability to assess the factual circumstances in which reference should be made under a particular legal system and the factual circumstances in which to use specific remedies provided for by the systems.
