The Master’s Seminar “Administrative Procedures” is devoted to the analysis of contemporary procedural issues related to the functioning of public administration and administrative judiciary. The course focuses both on the classical institutions of administrative proceedings and on new developments connected with the constitutionalisation of administrative law, the Europeanisation of administrative procedures, and the digitalisation of public administration.
The seminar covers, inter alia:
general principles of administrative proceedings;
constitutional procedural standards;
the right to good administration;
the principles of proportionality, legality, and protection of legitimate expectations;
remedies and appeals in administrative proceedings;
extraordinary review procedures;
administrative monetary penalties;
tacit settlement of administrative matters;
digitalisation of administrative procedures;
proceedings before administrative courts;
standards resulting from European Union law and the European Convention on Human Rights;
special administrative procedures in selected areas of public administration.
An important element of the seminar is the analysis of current case law of the Polish Constitutional Tribunal, the Supreme Administrative Court, the Voivodship Administrative Courts, the Court of Justice of the European Union, and the European Court of Human Rights.
The seminar has a workshop-oriented character. Students prepare presentations, analyse judicial decisions, present the concepts of their master’s theses, and participate in problem-oriented discussions. Particular emphasis is placed on developing academic research skills, the ability to formulate research problems and theses, and the ability to construct legal argumentation.
The outcome of the seminar is the preparation of a master’s thesis in the field of administrative procedures or, more broadly, administrative procedural law.
The student’s total workload includes:
participation in the seminar;
preparation of materials and presentations;
independent analysis of legal literature and case law;
drafting subsequent parts of the master’s thesis;
individual consultations with the thesis supervisor.

Learning outcomes
Upon completion of the seminar, the student:
Knowledge
knows and understands the basic as well as advanced institutions of administrative procedures;
is familiar with constitutional, European, and international standards for the protection of individual rights in administrative procedures;
is familiar with current trends in the case law of administrative courts and with the doctrines of administrative procedural law;
understands the relationship between substantive and procedural law in public administration.
Skills
is able to independently analyse normative acts, case law, and academic literature;
is able to formulate research problems and construct legal argumentation;
is able to prepare an academic thesis that meets the methodological requirements of a master’s dissertation;
is able to present the results of their own research and participate in academic discussions;
is able to critically assess procedural solutions applied in public administration.
Social Competences
is prepared to independently deepen and expand their knowledge;
understands the importance of the rule of law and the right to good administration;
demonstrates responsibility for the reliability and accuracy of legal analyses conducted;
recognises the importance of ethics and standards of professionalism in public administration and legal professions.
Assessment criteria
The basis for completing the seminar includes:
preparation and presentation of a paper concerning the subject matter of the master’s thesis;
systematic presentation of progress in the preparation of the master’s thesis;
preparation of parts of the master’s thesis in accordance with the schedule established by the seminar supervisor;
participation in problem-oriented discussions and the analysis of case law.
Practical placement
The course does not require the completion of professional internships.
