(in Polish) Spory sądowe z zakresu własności intelektualnej – warsztaty 2200-1PS048

The classes will take the form of workshops with elements of a lecture. They will concern the methodology of conducting disputes, taking into account the specifics of cases regarding the protection of intellectual property rights (both copyright and industrial property rights), as well as cases of acts of unfair competition—construction of the statement of claim, facts subject to proof, the role of expert evidence, and the distinctiveness of proceedings before intellectual property courts. An important part of the classes will be trial simulations: for the protection of moral rights, for infringement of the right to a renowned trademark, and others. Actual disputes that have occurred will also be analyzed

Prerequisites (description)

The classes are intended to familiarize students with the methodology of conducting litigation in cases concerning the protection of intellectual property. Due to the nature of the protected good, which is intangible, these disputes have their own specific characteristics, particularly in the area of evidence proceedings. The classes serve as a supplement and deepening of the knowledge conveyed in the Intellectual Property Law lecture.

Learning outcomes

•Knowledge of the basic elements of the methodology for conducting disputes concerning the protection of: copyright, trademark registration rights, industrial design registration rights

• Ability to formulate a statement of claim in the above-mentioned cases

• Ability to formulate evidentiary motions in intellectual property cases

• Knowledge of the most important issues in the practice of intellectual property courts

Assessment criteria

Assessment will primarily take into account engagement in performing workshop tasks.
