1. The concept of negotiable instruments: classification, legal functions, and the mechanism of assignment.
2. Historical development of the law governing bills of exchange. Functions of a bill of exchange: credit, payment, circulation, and guarantee. Formation of obligation under a bill of exchange (theoretical perspective). Definition of a bill of exchange.
3. Legal framework regulating bills of exchange: The Hague and Geneva Conventions providing a Uniform Law for Bills of Exchange and Promissory Notes. Codification of bill of exchange law in Poland. The Polish Bill of Exchange Act of 1936.
4. Drafts and promissory notes: parties to the bill of exchange transaction; bill of exchange clauses; a blank bill.
5. Transfer of rights under a bill of exchange: endorsement forms and types.
6. Aval (suretyship on a bill of exchange) and its legal nature.
7. Acceptance, maturity, and payment of bills of exchange. Holder’s title and rights.
8. Protest, notice of dishonour, and recourse mechanisms.
9. Nature of liabilities under bills of exchange. Defences against liability on a bill of exchange.
10. Judicial enforcement of claims arising from bills of exchange.
11. Historical development of cheque law. Cheque functions and definition.
12. Legal regulations governing cheques: The Geneva Conventions providing a Uniform Law for Cheques. Codification of cheque law in Poland. The Polish Cheque Act of 1936.
13. Formation of obligations under cheques. Parties to a cheque transaction. Types of cheques. Differences between a draft and a cheque.
14. Transfer of rights under a cheque. Presentation and payment. Consequences of non-payment.
15. Practical exercises: Issuance of bills of exchange and cheques.
