Although private law is most often explored from a doctrinal perspective, it offers a remarkably wide range of research opportunities when approached using historical and comparative methods. This seminar offers participants the opportunity to engage with such a multi-layered research perspective.
During the initial weeks of the course, selected readings on methodological issues will be discussed. Afterwards, participants will choose their Master’s thesis topics. Proposed research areas range from Roman law and the history of private law, through the currently popular trend of comparative legal history, to doctrinal-comparative approaches. The issues analyzed may concern both the sources of private law and its institutions.
By way of example, previous theses written under the supervision of the seminar instructor have addressed topics such as: the prohibition of interest (usury) in Judaism, Islam and Christianity; the legal protection of access to daylight in English law; ius abutendi as a component of ownership; the legal status of treasure trove; the evolution of the superficies solo cedit principle; and the institution of the trust in the law of Louisiana.
The selected topics will be discussed within the group, after which work will proceed in a more individualized format, through regular consultations with the instructor.
Students interested in doing so may write their Master’s thesis in English or prepare it in the form of an academic article.
