Prerequisites (description)
The aim of the proseminar is to analyse case law, legislation and legal doctrine in the fields of: commercial law, capital markets law, banking law, the law of obligations, and the law of new technologies. The seminar format involves the lecturer sending out a judgment (or other text) – naturally well in advance – and a joint analysis of that judgment during the session. . In essence, this is a workshop (discussion-based) format. ‘Pure’ civil law is not excluded either – with the exception of family and inheritance law (apart from matrimonial property regimes, where relevant to the core scope of the course). . The lecturer’s task is to alternate topics – so that the course is not limited to a single subject, such as limited liability companies or public limited companies. Should participants be interested, the topics of crypto-assets or AI may also be covered in the course.
In principle, classes are held in the lecture theatre. Exceptionally – in the case of an Erasmus placement – online participation is possible; however, contact must be maintained via a participant (preferably two) present in the lecture room.
Learning outcomes
Enhancement of skills in the analysis of case law as well as communication skills in legal language.
Assessment criteria
Attendance at classes. Permitted absences – two per semester, without the need for formal justification. Exceptional circumstances are subject to individual discussion and the lecturer’s decision.
Bibliography
Sent by the lecturer prior to the class. Suggested during the class.
