Specialisation Seminar - Intellectual property. Contemporary problems of protection 2200-1F009
The analysis will cover specific intellectual property rights and copyrights. Within the scope of harmonisation of the intellectual property rights in the European Union, the judgements of the Court of Justice of the European Union will be analysed. The seminar will discuss the principal aspects of the specific rights affecting the current interpretations of the scope of protection of those rights. The analysis of specific rights will be focused first of all on the related restrictions in order to present the relations between the protected exclusivity and the admissible actions of third parties. The examples discussed during the classes will enable the students to understand the merits and importance of protection of intellectual property rights, as well as the impact of those rights on the functioning of societies and economies. The analysis will include such rights as: patents, protective rights to trademarks, design registration rights, geographical indications and copyrights, with particular focus on the so-called online breaches. The classes allow developing the knowledge obtained during the lecture entitled Rights to intangible assets, and expanding the knowledge presented during the module entitled Intellectual property law and intangible goods.The participants will be able to learn about the key and current aspects of protection of intellectual property rights. During the classes, judgments of the CJEU and the case law of national courts are used.

11) Sccope of protection of individual intellectual property rights - the most important interpretation problems;

Learning outcomes
After the class, the participants should be familiar with the principal problems arising in connection with the functioning of the protection systems of intellectual property rights. The participants will understand the importance of those rights for social development, simultaneously being aware of the restrictions inherent to that system. The seminar participants should also be able to apply the obtained knowledge, understanding its practical impact, and use the legal acts comprising the intellectual property law system in practice. The classes are also aimed at making the students familiar with the role played in the domain of intellectual property law by the European Union law and case-law of the Court of Justice of the European Union. Acquisition of the ability to critically analyse the intellectual property law norms and practically apply the case-law and doctrine also constitutes an important result of learning.
Assessment criteria
The assessment takes into account students’ activity during classes, their preparation for the classes and additional activity involving presentation of specific issues.
