Basics of Knowledge of Law 2105-PP-L-D1PWPR
The classes will be devoted to the following topics:
I. The essence and concept of law, the relationship between law and the state, law and other sets of social norms (e.g. morality), specificity of legal sciences; legal language and legal language;
II. The concept of the legal system. The concept of the rule of law (in formal and material terms), the concept of justice;
III. Legal act, normative acts, individual acts. Legal provision, types of legal provisions. Legal norm and its structure: hypothesis, disposition, sanction. Legal relationships, elements of the legal relationship (parties, subject matter, content of the legal relationship). Legal events.
IV. Sources of law, forms of law creation, system of sources of law in the Republic of Poland (constitutional classification of sources of law: sources of generally applicable law and sources of internal law), publication and announcement of normative acts.
V. Validity of the law: in space, in time (vacatio legis, lex retro non agit), personal validity of the law.
VI. Obeying the law, violating the law, circumventing the law, "civil disobedience".
VII. Application of law, factual presumptions, legal presumptions, the institution of nullum crimen sine lege.
VIII. Interpretation of law (concept, types), binding force of interpretation of law, interpretation by the Supreme Court. The legal system, public law and private law, substantive law and public law, internal state law and public international law, branches of Polish law.
IX Basics of constitutional law. The concept of constitution and constitutional law, structure, basic principles of the Polish political system, the principle of separation of powers, basic freedoms, rights, obligations of man and citizen.
X. Basics of administrative law. The concept and essence of administrative law, division of administrative law: systemic, material, formal. Administrative-legal relationship, legal forms of public administration activity.
XI. Basics of civil law. The concept and essence of civil law, sources of civil law, systematics of civil law. Civil-legal relationship. Civil law entities: natural persons, legal persons, legal capacity, capacity to perform legal acts. Basics of inheritance law.
XII. Basics of criminal law. The concept and essence of criminal law. Substantive criminal law. Scope of application of criminal law. The concept of crime, guilt. Circumstances excluding criminal liability. Types of crimes. Penalties and punitive measures.
XIII. Basics of EU law. The concept and essence of EU law, sources of EU law, EU institutions, EU law and the law of member states.
XIV. Problems and dilemmas regarding the creation, application and observance of law in Poland.

KNOWLEDGE
The student understands the importance of legal sciences for European studies. The student has knowledge of both the essence of legal theory and the dogmatics of law, and also understands the importance of legal regulation for the functioning of the public sphere and the sphere of private entrepreneurship in the perspective of the activity of the state and citizen at the national and supranational (European, international) level. The student knows and understands the importance of law as one of the tools for regulating the internal and external relations of the state, knows and understands the evolution of legal systems from the police state, through the state of law to the democratic state of law. Recognizes the scope of regulations in national law, international law and the essence, scope of regulations and distinctiveness of Community/European law (K_W02)
SKILLS
The student is able to observe, interpret, analyze and describe the processes of: establishing, interpreting, applying the law and observing, circumventing and violating the law. Is able to interpret individual processes as the area of activity of state authorities, EU authorities and/or citizens (K_U01)
The student is able to use (search and interpret) the norms of common law (public and private) regulating the functioning of entities in the public and private spheres (K_U05)
Assessment criteria
Ongoing assessment, point assessment for written work, additional points for substantive activity in classes and for homework.
