European economic law 2104-M-D1PGUE
The lecture is to introduce students to basic knowledge about the legal basis for the functioning of the internal market and other selected branches of economic substantive law of the European Union. The lecture is not only a synthetic presentation of the matters covered junctions indicated the scope of the above, but also to highlight the most important problems in the practical application of force under EU regulations relating to the sphere of economic activity.
Classes expected to be complementary in relation to the lecture. Objective of this course is to analyze case studies that will correspond to the scope of the discussed topics during the lectures. Solving specific problems, students will have the possibility of practical application of knowledge gained during the lectures and during the curing individual study. An important element of the analysis of case studies, will be learning the proper argumentation and relying on the judgments the European Union Court of Justice.
Scope of classes includes the following topics:
1st The concept of economic law of the European Union - the scheme of legal norms.
2nd Internal Market - the concept, sources of law, the amendments made in the Treaty of Lisbon.
3rd Free movement of goods: the notion of the goods, the scope of free movement of goods, the permissible restrictions on the free movement of goods.
4th Free movement of persons, free movement of employed persons (the scope of freedom, the right of workers connected with the stay and work, rights of family members, the right of citizens of third countries interested in working within the EU)
5th Free movement of persons: the right of establishment (and the scope of the subjective right of establishment; content of the right of establishment; permissible restrictions on freedom of establishment; elements of European company law)
6th Freedom of movement - the concept of service, the subjective and objective the free movement of services, the permissible restrictions on the free movement of services)
7th Free movement of capital - the concept of capital, scope and content of free movement of capital, the permissible restrictions on the free movement of capital
8th Free movement of payments - the concept of current payments, the scope of free movement of payments, permissible restrictions on the free movement of payments
9th EU competition law - the concept, sources of law, scheme of legal norms.
10th Rules of competition concerning undertakings (Part I) - the concept of business in EU competition law, the relative prohibition of agreements restricting competition and its scope, exemptions from the prohibition on restrictive agreements block exemption
11th Rules of competition concerning undertakings (Part II) - the concept of dominant position and the relevant market, the concept and the absolute prohibition of abuse of dominance, legal basis for the prevention of excessive concentration, subject, scope and competence of audit processes, concentration, control criteria (competition test) and procedural issues.
12th Competition rules for the Member States. State trade monopolies and public enterprises: the rules of state monopolies, order transformation of state monopolies in trade in goods trade, state monopolies and financial service providers and public sector enterprises under the EU competition rules.
13th Prohibition of anti-competitive state aid. Public support - the concept of state aid, a ban on public assistance, public assistance will automatically be permitted, conditionally permitted public aid, state aid control
14th Safety and health protection of consumers in EU law: a system of specific rules on product safety (food, pharmaceuticals, hazardous substances, etc..), General product safety (the manufacturer's responsibilities for product safety, government oversight of product safety), the responsibility for unsafe products, Directive a new approach to health and safety of consumers, the RAPEX system and its operation in Member States
15th The rights of the consumer information, regulations and conditions of sale of consumer credit: requirements as to the description of the products and prices, illegal clauses responsibility for the quality of the service (legal basis, the extent of subjective and objective consumer sales, terms and powers of redress consumer complaints), a modern form of sales ( sales outside the office of the company; distance contracts), consumer loans (the subject of regulation and the scope of protection)

Learning outcomes
At the end of the course (including both lecture and classes) the student should have:
- the knowledge of the European economic law prescribed in the program of the course;
- the ability to apply the gained knowledge in practice, in order to solve problems falling within the scope of the European economic law;
- the knowledge of the fundamental rights of individuals and companies according to their participation in the EU internal market, and the ability to deal with their practical use in the context of individual activity
