International jurisprudance in domestic courts: case study 1600-SZD-SPEC-OM-PR
The contemporary processes of globalization bring about profound changes in the international legal system. We witness a significant proliferation of international regulations, and their scope not only undergoes extensive expansion but also deepening. This results in a substantial convergence of norms with both national and international character. At the same time, international law increasingly grants broader rights to individuals and private entities, determined to defend them through legal recourse in all possible forums. Consequently, national courts now adjudicate matters and disputes that just a few decades ago were the exclusive domain of international tribunals. All these changes lead to a significant convergence between international tribunals and national courts in the execution of their functions. The former increasingly rely on domestic decisions in interpreting international agreements and determining customary law norms. Likewise, domestic judgments often become the subject of dispute resolved by international judges. Their national counterparts also refer to and cite international jurisprudence when applying international law. Sometimes, parties to proceedings attempt to ensure the enforcement of international judgments within domestic legal frameworks through national courts. The seminar aims to examine the relationship between national and international courts and the impact of international case law on the adjudicative activities of national judges. Selected cases from various fields of law, both public and private, from different jurisdictions and legal systems, will be subjected to analysis and collective discussion. The seminar intends not only to broaden doctoral students' knowledge of legal issues but also to draw their attention to the internationalization of matters within their sphere of academic interest.
